Terms of Service

These Terms of Service (“Terms”) govern your access to and use of services, applications, and products provided by OH Sweet Hospitality, LLC (“we,” “us,” or “our”), including but not limited to SweetTemp, SweetCost, OH Waiter!, and any associated tools, digital products, or consulting services. By using our services, you agree to these Terms.

1. 

Use of Services

You agree to use our products and services only for lawful purposes and in accordance with these Terms. You must be at least 18 years old or the age of majority in your jurisdiction to use our services.

2. 

Accounts and Access

To access certain services, you may be required to register an account. You are responsible for maintaining the confidentiality of your account and password and for all activity under your account. You agree to notify us immediately of unauthorized use.

3. 

Payment and Billing

For paid services (e.g., Sweet Spot Society, OH Waiter! plans, consulting packages):

• Fees are billed as agreed upon in your service agreement or plan level
• Setup fees are due before implementation
• Subscription renewals are billed monthly or annually unless canceled
• Late payments may result in suspension of service

No refunds are provided unless stated otherwise in writing.

4. 

License and Restrictions

You are granted a limited, non-exclusive, non-transferable license to use our software and digital tools. You may not:

• Resell, sublicense, or modify our services without permission
• Reverse engineer, copy, or misuse our code or designs
• Use our services for illegal or fraudulent purposes

5. 

Client Data and Privacy

You retain ownership of your data. We will only use your data in accordance with our Privacy Policy and applicable laws. You are responsible for the accuracy and legality of the data you provide.

6. 

Third-Party Tools and Integrations

We may use third-party services such as ManyChat, Google Sheets, or hosting providers to deliver certain features. By using our tools, you agree to their applicable terms as well.

7. 

Support and Availability

Support is provided via email at help@ohsweet-hospitality.com. We strive for uptime and reliability but do not guarantee uninterrupted service. Scheduled maintenance or updates may temporarily affect availability.

8. 

Termination

We may suspend or terminate access to our services at our discretion if you breach these Terms or misuse the platform. You may cancel your subscription at any time, but fees already paid are non-refundable.

9. 

Intellectual Property

All content, trademarks, service names, and original materials provided by OH Sweet Hospitality, LLC remain our intellectual property and may not be reproduced or reused without permission.

10. 

Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages related to the use or inability to use our services. Our total liability will not exceed the amount you paid us in the preceding 3 months.

11. 

Changes to Terms

We may update these Terms from time to time. We’ll notify you of material changes via email or on our website. Continued use of our services means you accept the revised terms.

12. 

Governing Law

These Terms are governed by the laws of the State of Minnesota. Any disputes shall be resolved in courts located in Lyon County, MN.
